This course covers: the need for wills, trusts, and related documents: document drafting techniques: the substantive and procedural law of will, trusts and estates; and the estate administration and court processes.

 

REQUIRED TEXT: Wills, Trusts, and Estate Administration, 6th Edition, Dennis R. Hower and Peter T. Kahn (Thomson/Delmar Learning).

 

COURSE TOPICS:

 

  1. The Estate Plan and the Purpose and Need for a Will
  2. The Concept of Property Related to Wills, Trusts, and Estate Administration
  3. The Participants and the Proper Court
  4. The Law of Succession: Death Testate or Intestate
  5. Wills: Validity Requirements, Modification, Revocation, and Contests
  6. Preparation to Draft a Will: Checklists and the Client Conference
  7. Final Draft and Execution of a Valid Will
  8. Introduction to Trusts
  9. Classification of Trusts, the Living Trust, and Other Special Trusts
  10. Personal Representatives: Types, Pre-Probate Duties, and Appointment
  11. Probate and Estate Administration

 

TEACHING PROCEDURES

 

In class lectures, questions and answers, and review question assignments. Homework assignments: reading, questions, contemporary issues in the news. Instructional Objectives: Understand the basic law and procedures, drafting techniques, and court process of estate and trust administration.

 

Grading:           15% - Quizzes (unless designated as a practice quiz)

                        10%   - Attendance, participation, and homework

75% - Exams –

40% midterm exam – just after mid-semester

35% final exam – at end of semester
